1. Scope & Applicability
These Terms govern all bookings and services provided by TimeLux Travel (“TimeLux,” “we,” “us,”
“our”) online, by phone, or by email. Supplier terms (airlines, hotels, cruise lines, ground
operators) also apply and may impose additional rules. By booking or paying you accept these
Terms.
2. Payments, Authorization & Accepted Methods
- Accepted methods: major credit/debit cards (Visa, MasterCard, American Express, Discover),
PayPal, Venmo (business accounts only), and Zelle (to our designated business account). Other
processors shown at checkout may be used.
- By providing payment information you warrant you are authorized to use the method and
authorize TimeLux and its processors to charge amounts due (consultation fee, deposits,
balances, taxes, fees, supplier penalties).
- All charges are in the currency displayed at checkout. Bank or processor conversion fees are
the customer’s responsibility.
3. Consultation Fee, Deposits, Final Payment & Non‑Refundability
- Consultation fee: A non‑refundable, non‑transferable consultation fee of $500 USD is required to initiate itinerary planning. This fee is payable when booking a consultation, covers planning time and proposals, and will be itemized on your invoice. It is separate from reservation deposits and travel payments.
- Most bookings require a deposit (non‑refundable unless otherwise stated). Final payment deadlines are shown on your invoice/confirmation. Failure to pay by the due date may result in a change of price quote (prices are subject to change), cancellation and forfeiture of payments made.
- Unless expressly stated otherwise in writing, payments to TimeLux are non‑refundable and non‑transferable due to supplier contract restrictions.
4. Refunds, Cancellations & Supplier Policies
- To cancel, submit written notice to book@timeluxtravel.com no later than 30 days prior to trip start date. Cancellation fees and refund eligibility are governed primarily by supplier rules; TimeLux will attempt to obtain any available refunds or credits but cannot guarantee supplier compliance.
- Refunds, when available, will be returned to the original payment method where possible. Processing timelines vary by payment provider.
5. Passenger Information, Names, Passports & Visas
- Bookings must use the traveler’s full legal name as shown on the passport or government ID used for travel. You are responsible for accurate personal and passport data. Fees, penalties, or re‑issuance costs resulting from incorrect information (including name changes) are the responsibility of the traveler.
- Travelers are responsible for securing required passports, visas, and entry documentation. Passports should generally be valid for at least six months beyond travel dates unless the destination or carrier specifies otherwise. TimeLux provides guidance for U.S. citizens only; non‑U.S. citizens must verify requirements with the relevant consulate.
6. Health Requirements, Vaccinations & COVID‑19 Policy
- Traveler must comply with all health, testing, vaccination, and quarantine requirements imposed by carriers, suppliers, and destination authorities (including COVID‑19 or other public‑health mandates). Requirements may change rapidly; verify and meet them before travel.
- TimeLux may require proof of vaccination, negative tests, or other health documentation and may deny travel or cancel a booking if required documentation is not provided. TimeLux is not liable for costs or losses resulting from your failure to comply.
- We strongly recommend travel insurance that covers COVID‑19–related illness, quarantine, testing, and medical evacuation where appropriate.
7. Travel Insurance
Purchasing travel insurance that covers trip cancellation/interruption, medical expenses, evacuation, and baggage delays or damages are strongly recommended and may be required for some bookings. Purchasing insurance is the traveler’s responsibility.
8. Chargebacks, Disputes & Billing Issues
Contact book@timeluxtravel.com or +1 (762) 379-9336 to resolve billing disputes. Initiating a chargeback without contacting TimeLux first may result in suspension or cancellation of services and liability for chargeback fees and losses.
9. Late Payment, Reinstatement & Last‑Minute Bookings
- Late balances may incur administrative fees (e.g., USD $250 where specified). If your reservation is canceled for non‑payment, reinstatement may be permitted within 14 days upon payment of a reinstatement/service fee plus any supplier reconfirmation costs.
- Last‑minute bookings may require immediate full payment and are subject to supplier availability; if services cannot be confirmed, collected funds will be refunded per supplier terms.
10. Supplier Changes, Delays & Force Majeure
- TimeLux acts as agent for independent suppliers and is not liable for their acts, omissions, delays, cancellations, overbooking, or price changes. We will assist in seeking remedies but cannot guarantee supplier compliance.
- We are not responsible for events outside our control (force majeure), including natural disasters, government action, pandemics, strikes, terrorism, or civil unrest.
11. Airlines, Tickets & Baggage
Airline ticketing, baggage allowances, seat assignments, and fees are governed by the airline. Once tickets are issued they may be non‑refundable and subject to fare rules. Name corrections or reissues after ticketing may incur full reissue costs plus administrative fees.
12. Accessibility, Special Needs & Service Animals
Notify us in writing of mobility, medical, dietary, or accessibility needs before booking so we can evaluate reasonable accommodations. Many international suppliers are not ADA‑compliant; TimeLux cannot guarantee accommodations for wheelchairs, scooters, or service animals on all itineraries. Service animal restrictions may apply to certain escorted or international programs.
13. Passenger Agreement, Release & Assumption of Risk
All passengers must accept a Passenger Agreement acknowledging travel risks and releasing TimeLux from liability for third‑party supplier acts to the extent permitted by law. You may be required to sign or electronically accept this agreement prior to travel.
14. Emergency Medical Care & Consent
Traveler authorize TimeLux, local agents, or medical providers to arrange emergency medical treatment if necessary. You are responsible for related medical and evacuation costs.
15. Privacy & Data Use
We collect and share personal data necessary to make reservations and to comply with security requirements (e.g., Secure Flight). Our Privacy Policy describes data use, retention, and sharing with suppliers. By booking you consent to necessary data transfers to third‑party providers.
16. Liability Limitation, Governing Law & Dispute Resolution
- Except where prohibited by law, TimeLux’s liability for claims related to a booking is limited to amounts actually paid to TimeLux for that booking. TimeLux is not liable for indirect, special, or consequential damages.
- These Terms are governed by the laws of the State of Georgia. Disputes will be resolved by binding arbitration under the Federal Arbitration Act in Atlanta, GA, administered by AAA or JAMS, unless otherwise required by law.
17. Marketing, Photographs & Media Use
By participating in TimeLux programs you consent to being photographed or filmed and allow TimeLux to use such images for promotional purposes unless you notify us in writing before travel.
18. Updates to Terms & Notices
We may amend these Terms. Material changes will be posted on our website with an effective date and will apply to bookings made after posting.
